FACS Manual Revision

1. Warranty of identity. I warrant that any photograph, video, or other digital media (collectively “Photo”) I upload onto this site is a Photo of me. 2. Grant of License. I wish to contribute a Photo of myself to the ongoing project of teaching and learning Facial Action Coding Systems (“FACS”) to help ensure that the images and videos represented in FACS guidance documents represent the wide variation of faces on this planet. By uploading my Photo here, I grant Erika Rosenberg, PhD, and Erika Rosenberg Consulting, LLC, (collectively “FACS Expert”) an irrevocable license and permission to use (in exchange only for participating in FACS education and no other payment or compensation) my Photo in any and all of FACS publications and for the purposes described below, including web-based publications. By contributing videos, there is no guarantee that your contribution will be featured in the final manual, as it is subject to various selection criteria. 3. Photos Irrevocably Become Property of FACS Expert. I understand and agree that all Photos I upload will become the property of FACS Expert and will not be returned, and that I cannot later revoke the license and permission I grant today. 4. Licensed Use. I hereby irrevocably authorize and license FACS Expert, to use, edit, alter, copy, exhibit, publish, or distribute these Photos for any lawful purpose, including, without limitation, for publication or other commercial uses, with or without identifying, acknowledging, or crediting me. In addition, I waive any right to inspect or approve the finished product wherein my photo/video appears. Additionally, I waive any right to royalties or other compensation arising from or related to the use of the Photo. 5. Indemnification. I hereby indemnify, hold harmless, release, and forever discharge the FACS Expert from all claims, demands, and causes of action which I, my heirs, representatives, executors, administrators, or any other persons acting on my behalf or on behalf of my estate have or may have by reason of this authorization and license. 5. Privacy Notification. In accordance with the General Data Protection Regulation (EU) 2016/679 (“GDPR”), FACS Expert is committed to protecting your Photo. By signing this form, you acknowledge and consent to the following: A. Purpose of Processing FACS Expert may collect your personal information and capture, use, and store Photos for use in published and publicly available print, digital, and video formats, including, without limitation: FACS manual; FACS Manual revisions; websites; social media platforms; and course materials. B. Legal Basis for Processing The legal basis for processing my personal data and Photos is consent, as per Article 6(1)(a) of the GDPR. C. Data Storage and Access FACS Expert will not keep any Photo I upload private. The Photos may be stored by FACS Expert indefinitely and also shared widely with third parties such as media outlets, printers, or social media platforms as needed for publication, which publication and use cannot reasonably be reversed. D. Retention Period FACS Expert may retain my Photo for as long as it is relevant to the purposes stated above, and I cannot revoke the license I grant to store or use any Photo after I upload the Photo. E. Right to Withdraw Consent I understand that I may withdraw my consent to future collection and processing of personal data from this website at any time by contacting Data Protection Officer, Erika Rosenberg, PhD, and that this withdrawal will not affect the lawfulness of any processing carried out before the withdrawal and will not act to revoke the consent, license, and permission granted for any earlier-uploaded Photo. F. Rights of the Data Subject I understand that under the GDPR I have the right to request access to, rectification, or erasure of my personal data; restrict or object to processing of personal data; and lodge a complaint with a supervisory authority. This right does not give me the right to retroactively revoke the consent, license, and permission I grant when I upload a Photo. G. Voluntary Consent I understand that providing consent is voluntary and that I am under no obligation to agree to the processing of my personal data or the use of my image. I HAVE READ AND UNDERSTOOD THE AGREEMENT ABOVE. If I am under 18 years of age, I confirm that I have obtained the consent of my parent or legal guardian, who has reviewed the entire agreement above and whose signature appears below.
